Companies that, having not been forced to close, are out of work for providing services to sectors that are confined, also have access to the simplified lay-off.
According to the newspaper ECO, in this second confinement, it is no longer enough to have a significant drop in turnover to access the simplified lay-off, a support scheme for maintaining jobs that allows employers to suspend employment contracts or reduce workers’ hours at the same time who receive aid for the payment of wages and benefit from exemption from social contributions.
The simplified lay-off is available to employers who are “subject to duty to close facilities and establishments by legislative or administrative determination of governmental source, within the scope of the pandemic of the disease covid-19 ″, according to Social Security.
Thus, access to the regime in question was being blocked to companies that provide services to sectors that are confined, since they are not technically closed or suspended due to legal or administrative imposition, despite being out of work because of that confinement. This is the case, for example, of a cleaning company that provides services to a gym.
According to Business Newspaper, the question was taken to the government by the social partners at the beginning of the month, and the minister of labor assured the employers’ confederations that an extension of the simplified lay-off would be made in order to cover the companies that provide services.

61 thousand companies receive support this Wednesday
The Social Security Institute (ISS) announced this Monday that it will pay 61 thousand companies, on Wednesday, the support related to the lay-off and the support to the progressive recovery, in a overall value of 135 million euros.
The support related to the lay-off (simplified and the Labor Code) and the extraordinary support to the progressive resumption, regarding the valid orders that were delivered until the 19th of this month, will be paid next February 24th ”, it is read in a note published this Monday by the ISS.
According to the note, “135 million euros will be paid to a total of 61 thousand entities employers, with 334 thousand workers covered ”.
In the case of the lay-off, support will be paid to 45.8 thousand companies with 219 thousand workers, worth 88 million euros.
The support for the progressive recovery includes the 15.4 thousand companies, with 115 thousand workers, in the amount of 47 million euros.
According to Social Security, on Wednesday, “the retributive compensation to make up 100% of the normal net remuneration”, Up to the limit of three national minimum wages (1,995 euros)“ with retroactive effect to January ”.
In the case of support for the progressive recovery, this additional will be paid retroactively to January and February to March 16, indicates the ISS.
With the entry into force of the State Budget for 2021 (OE2021), the workers covered are now entitled to receive 100% of their remuneration (against the previous two thirds) up to the limit of three national minimum wages (1,995 euros). This additional charge is financed by Social Security, with the companies being responsible for paying about 19% of the 100% of the remuneration (equivalent to the previous 30% of two thirds).
