A year after discussing politics with José de Abreu and being called “sclerosed”, Carlos Vereza suffered his first defeat in court against his colleague. In January 2020, the veteran felt that his honor was shaken by the actor and initiated a criminal complaint. The lawsuit runs in the 34th Criminal Court of the Rio de Janeiro Court of Justice and was rejected in a decision last month, as the judge understood that the defendant did not commit the alleged crimes.

The imbroglio started on January 27, 2020. In his social networks, Abreu made harsh criticisms of Regina Duarte, who at that time had just accepted the invitation of Jair Bolsonaro to take over the special secretary of Culture.

Vereza went to social media to ask the 74-year-old actor to respect the choices of his professional colleague. “Hello, José de Abreu! Respect Regina Duarte! Respect the choices different from yours! I have always treated you kindly, accepting your point of view on ideological issues. Why always vibrate in hatred, in low energy? Look for yourself on the side more generous, which he certainly has “, he started.

“Although I don’t believe it, we are in a democracy, 57 million voters made a choice, just like you. Forget the sad adjectives, the country lacks kindness. Wait, calmly, until 2022 and vote for your candidates,” he wrote on his Facebook, who quoted a verse by Arthur Rimbaud (1854-1891) for his colleague.

Abreu then went to Twitter to reply and comment on the 81-year-old artist’s text. “My dear colleague, Carlos Vereza. I thought your appeal was very nice for me to respect Regina Duarte. But, unfortunately, I do not respect neither fascists nor those who support them, like you and her”, he published.

“I found his hypocrisy beautiful, his lack of character and memory, worthy of a sclerosis that usually talks to supposed aliens, considered ‘superior spirits’ who came to visit him on flying saucers, as you can see in a video posted on the network”, continued.

In his response, Abreu recalled an episode that would have happened backstage at Globo’s Corpo Dourado (1998), in which Vereza allegedly assaulted a colleague by profession with a cane.

“I also found your quote from Rimbaud, a crazy artist like me, not like you, sick, who sees flying saucers very beautiful. A healthy, productive madness, as every artist must have. Like mine, which attacks fascists and fascist supporters. , like you and Regina Duarte, but who never throws a cane at a colleague at the beginning of his career, on the scene, as you did in the soap opera Corpo Dourado. I was there and I saw “, he declared.

The whole discussion became the subject of a lawsuit initiated on February 13, 2020. The veteran alleged that the actor committed the crimes of slander, injury and defamation after being offended in publications on the social network, which were viewed and propagated by thousands of people.

On January 30, however, Judge Rudi Baldi Loewenkron rejected the criminal complaint and refuted Vereza’s allegations.

THE TV News had access to the records in which the veteran makes his considerations and complaints about what was said by the colleague. According to his defense, Vereza felt slandered for being accused of assaulting “a professional colleague in the exercise of his activity” when it was said that he had thrown a cane at her.

The magistrate understood that “throwing a cane at a co-worker does not matter in an evident way in practice a fact defined as a crime, as there is no news of a result (offending the bodily integrity or the health of others). There is no information even that has hit the target (person towards whom it would have been thrown), or physical injury occurred. There is no explanation of the circumstances, which also prevents the attempt of the penal type. Therefore, it is in fact atypical “, he said in his statement. decision.

Botelho’s interpreter in Under Pressure also claimed that he was defamed when he was called “fascist and supporter of fascists”. The judge analyzed that the actor’s reputation was not damaged in that speech.

“The word fascist, considered by the appellant to characterize crime, is an adjective. Supporting fascist is not a fact, an event, it is a term that is used in a pejorative way. However, it does not configure the crime on screen because it was not attributed to the pleading a fact offensive to his reputation “, he concluded.

Finally, Vereza declared that the crime of injury was committed by insinuating that he would be “hypocritical, without character, sclerotic and fascist”. The magistrate then pointed out that the experienced artist stimulated the actor’s response by first publishing a text for the interpreter on a social network.

“The plaintiff responded to the plaintiff’s provocation,” he said. Thus, Abreu’s responses were seen as a consequence of the alleged offended person’s own act. “The judge may fail to apply the sentence when the offended person, reprovingly, directly caused the injury,” he continued.

“For these reasons, I see no evidence of authorship and proof of the existence of sufficient crimes to trigger private criminal action, which is why I reject the criminal complaint,” concluded Loewenkron in his dispatch.

Sought, the defense of Vereza informed that it will appeal the decision. “Nothing much. It was his understanding [do juiz] which will be reviewed at second instance. There is still no final decision, “he informed.” There is another action in progress, but in secret from the courts. I suggest we wait for the final result of the actions “, he added.

The other side

With the criminal complaint rejected, José de Abreu was not officially cited in the case. To the TV News, the actor, who now lives in New Zealand, said he knew “over” Vereza’s action against him, but that he had received the information that “he had given up”, which did not happen.

The artist added that he is also unaware of the second lawsuit that runs in secret from Justice. “Leaves Brazil on November 23 [de 2019], the day I finished recording A Dona do Pedaço. So, I can’t be subpoenaed. I spent three months traveling through Oceania. Today I have been living in New Zealand for a year. I cannot have been summoned. I am not in Brazil “, he considered.

“We’re going to bring this down to the Supreme Court [Tribunal Federal]. We are all going to the Supreme to discuss freedom of expression. He must have been pissed at the story of the cane. It is full of witness. What I told you was a public note “, he observed.

In 2017, Abreu and Vereza worked together in Os Dias Eram Assim, on Globo. According to him, the friendship was great until then. However, political differences have become more provocative in recent years.

“I don’t understand with a cultured and informed person how he makes these mistakes. I think he should thank me for alerting him that he is on the wrong path. I love him. The last time we met, we looked at each other and hugged each other. “, recalled Abreu.

“He’s always on the wrong side [na política]. I never changed sides and life is proving to me that I am right “, he said.

Apart from the opposing opinions about politics, Abreu went further and called his colleague “sclerotic” in his responses, which offended him and ended up in the case file.

“It’s just that I get a little nervous at the time,” he explained. “But I think he should thank me because sclerosis would even justify his completely wrong positions. But, okay. I apologize. I just don’t apologize to Regina Duarte,” he concluded.
