In the representation made to the Ethics Council by the Board of Directors of Chamber of Deputies, the top of the House calls for the repeal of the mandate of the federal deputy Daniel Silveira (PSL-RJ) for breach of parliamentary decorum. Unlike what was being suggested behind the scenes, the document does not speak of temporary suspension. The information appears in the Official Gazette of the Chamber this Thursday, 18. The Bolsonar parliamentarian was arrested on the night of Tuesday, 16, after the publication of a video with attacks on members of the Supreme Court (STF). The minister’s decision Alexandre de Moraes was unanimously endorsed by the plenary of the Court, this afternoon, Wednesday 17.
“Characterized, since the hypothesis of abuse of prerogatives, this Representation is referred to the Council of Ethics and Parliamentary Decorum, for the purposes of
art. 240, § 1, of the Internal Regulation, in combination with arts. 10, item IV, and 14, caput and § 3, of the Code of Ethics and Parliamentary Decorum, both from the Chamber of Deputies ”, says an excerpt from the representation. According to item II of article 240, the deputy whose procedure is declared incompatible with parliamentary decorum loses his mandate. Articles 10 and 14 of the Code of Ethics and Parliamentary Decorum, in turn, affirm, respectively, that one of the punishments applicable for conduct that violates or is incompatible with parliamentary decorum is the loss of mandate and that the case will be sent to the Ethics Council for the initiation of disciplinary proceedings. In the representation, the Bureau also states that “in addition to attacking the Ministers of the Supreme Federal Court (STF) head-on through various threats and offenses to honor”, Daniel Silveira “expressly proposes anti-democratic measures against that Supreme Court, defending the AI-5 , the immediate replacement and adoption of violent measures against the life and safety of all Ministers ”.
In the video published on social networks, deputy Daniel Silveira apologizes for Institutional Act nº 5, AI-5, which closed the Congress and toughened the repression during the Military Dictatorship, and states that he already imagined the STF ministers “taking a beating ”. “Over and over again I have imagined you taking a beating,” he said, addressing Minister Edson Fachin, rapporteur for Operation Lava Jato no Supremo. “How many times have I imagined you and all the members of this Court. How many times have I imagined you, on the street, getting beaten up. What are you going to talk about? That I am fomenting violence? No. I just imagined it. Even if I foresaw, it still wouldn’t be a crime. You know it wouldn’t be a crime. You are a poor lawyer. Go there and arrest Villas Bôas, quickly, just for us to see a little business, ”he added.
The custody hearing for Daniel Silveira takes place this Thursday afternoon, 18. Party leaders will meet after the hearing to decide what strategy will be adopted in the case of the arrested parliamentarian. The House plenary can decide whether to maintain or revoke the prison later this Thursday. According to a leader heard by Prime Time Zone on condition of anonymity, the tendency is for the House to maintain Silveira’s detention.
