In an interview with Prime Time Zone, deputy Fernando Rodolfo (PL-PE) stated that the report will be ‘technical’ and preached serenity, balance and responsibility
The president of the Ethics Council of Chamber of Deputies, Juscelino Filho (DEM-BA), chose, this Wednesday, 24, the deputy Fernando Rodolfo (PL-PE) as the case reporter Daniel Silveira (PSL-RJ) in the collegiate. Linked to the President of the House, Arthur Lira (PP-AL), the parliamentarian stated, in an interview to Young pan, that his opinion will be “technical, built with a lot of dialogue” and without the influence of “political passions”. At the session that endorsed the minister’s decision Alexandre de Moraes, of the Supreme Federal Court, (STF), on Friday, 19, Rodolfo voted to maintain the prisoner’s pocket parliamentary prison.
“We will focus on the Ethics Council if the speech of deputy Daniel Silveira represents a breach of decorum, which is what we have to preserve as parliamentarians. Does defending AI-5 and insulting Supreme Ministers break decorum? That is my assignment ”, he said. The deputy of the PL also affirms that it is of interest to the Board of Directors of the Chamber that the case proceeds quickly. See below the main excerpts of the interview:
The Chamber of Deputies approved the maintenance of Daniel Silveira’s prison, but many lawmakers openly said that Minister Alexandre de Moraes’ decision was wrong and exaggerated. How do you evaluate this case? I cannot express an opinion on the case, because it may end up giving direction to what I think. I have no opinion on the opinion. The prison episode has now been overcome. [O processo no Conselho de Ética] It is something completely different from the STF action that culminated in prison. Whether the arrest was legal or not, the Chamber has already decided in plenary. We will focus on the Ethics Council if Daniel Silveira’s speech represents a breach of decorum, which is what we have to preserve as parliamentarians. Does defending AI-5 and insulting Supreme Ministers break decorum? That is my assignment.
How long do you have to submit the report? Can you say anything about the opinion? I tell you it will be a technical report, built with a lot of dialogue, emphasizing the technical aspect of the piece. We are going to speed up because the faster, the better for the Chamber and for society, which is waiting for an answer. I will have to notify Congressman Daniel Silveira, who will have 10 working days to present the defense and, if he wants, list up to eight witnesses. Until his defense arrives here, I can’t do anything. My work starts there. Receiving the defense, I have 40 working days to instruct the process in the Ethics Council. Then, another 10 days to present the vote. I can ask for cassation, removal, filing or a lighter sentence – he can receive a verbal warning or removal with a term of less than six months. It certainly won’t be. The case requires a much larger, more technical and responsible analysis, also considering the repercussions that the case has gained.
What are the watchwords for your report? Serenity, balance and responsibility. I will not make a report influenced by political passions. Whoever expects a fixed idea from me does not know me. I don’t agree with that way. I will do it responsibly, use whatever time is convenient for me, to present a report to the Council based on the technical or legal issue.
You were chosen as the case’s rapporteur on the same day that the Chamber votes on the admissibility of the so-called Immunity PEC, seen as a response to the STF’s action in the Daniel Silveira case. Considering the spirit of the body that exists in cases like this, what is the guarantee that this episode will not be delayed until it falls into oblivion and, eventually, be shelved? The guarantee is the commitment that I, as the rapporteur, make a responsible analysis, without the spirit of corporatism. That is why I was chosen as rapporteur. I am guaranteed to stay until the end. I only leave the rapporteur if I wish, unlike any other committee. Let’s build. It is of interest to the Board of Directors [que esse caso avance]. The representation against Daniel Silveira is a representation of the Bureau, not from any party. It is the Bureau’s interest that this case be heard quickly. We will sit down with all the leaders who are interested in participating to build a technical report.
