Majority of ministers followed the understanding of Edson Fachin, who annulled the former president’s condemnations and ordered the sending of criminal actions to the federal capital
The Federal Supreme Court (STF) decided, on Thursday, 22, that the cases involving former President Luiz Inácio Lula da Silva will be sent to the Federal Court of the Federal District. Ministers Edson Fachin, Luís Roberto Barroso, Rosa Weber, Dias Toffoli, Cármen Lúcia and Gilmar Mendes voted in this regard. Ministers Alexandre de Moraes and Ricardo Lewandowski voted to send criminal actions to São Paulo. Nunes Marques, Marco Aurélio Mello and the President of the Court, Luiz Fux, argued that Lula’s case should remain in Curitiba.
Still in the session this Thursday, the plenary will analyze if the resources presented by Lula’s defense, among them the one that asks for Moro’s suspicion, lose their object. In the decision in early March, Fachin understood that, with the annulment of the former president’s convictions, the requests would not need to be judged. Even so, the Second Panel resumed the analysis on March 23 and declared the former federal judge a suspect. That is, the ministers will not decide, on the afternoon of this Thursday, if Moro was impartial in judging and condemning Lula in the cases of the Guarujá triplex and the Atibaia site, located in the interior of São Paulo, but if the Gang could have the trial continued with the declaration of “loss of object”.
