Marcelo directly refers the government to noise limits in buildings

The head of state included the detail “Government decree-law” in the new decree for the renewal of the state of emergency, to allow the Executive to limit noise in buildings.

In the last decree that implemented the state of emergency, currently in force, the Government ignored the President of the Republic’s recommendation on noise. For this reason, this Wednesday, in the new presidential decree that has already followed for Parliament, Marcelo Rebelo de Sousa added a small detail.

On the point about noise, the head of state clearly referred to the Executive the possibility of setting limits. “They can be determined, by government decree-law, lower noise levels in decibels or in certain hourly periods, in residential buildings, so as not to disturb teleworkers ”, quotes radio TSF.

The current General Noise Regulation defines neighborhood noise as all the sound associated with housing use and the activities inherent to it, produced directly by someone or through someone else, and also includes the noise of animals, when its duration, repetition or intensity affects public health or the tranquility of the neighborhood.

The law stipulates that between 11 pm and 7 am, (neighbors and) police authorities can demand an immediate end to noise. In the case of works that are a source of noise, although a special noise license is not required, they can only be carried out on working days, between 8 am and 8 pm.

The Zero association has already considered that the Government should establish, at least on a temporary basis, that “police authorities can at any time order the neighborhood noise producer to immediately cease the discomfort”.

The environmental association also defended that non-urgent works should be avoided or limited to a maximum period of four hours a day. This is because, according to TSF, it has received dozens of reports, in the last two weeks, from families who are telecommuting and with distance classes that are constantly being disturbed by the noise of other houses.

These are “very concrete situations of people, in most cases, complaining about works, but also of neighbors who make too much noise with music, or who speak too loudly in poorly isolated buildings”, explained Francisco Ferreira to the radio.

The presidential decree will be voted on this Thursday, in the Assembly of the Republic, and proposes the renewal of the state of emergency between 00:00 of March 2 and 23:59 of 16 of the same month.
