The Attorney General’s Office (PGR) denounced the former federal deputy and national president of the PTB, Robert Jefferson, for incitement to crime, homophobia and slander against the president of the Senate, Rodrigo Pacheco (DEM-MG). The complaint was filed by the Deputy Attorney General of the Republic, Lindôra Araújo, on the 25th of August. The PGR also asks the minister Alexandre de Moraes, of the Federal Supreme Court (STF), assess the possibility of house arrest – the defense submitted a request for habeas corpus to the Court and is awaiting a decision from the magistrate. Allied with President Jair Bolsonaro, Jefferson was pre-emptively arrested on the 13th, as part of the investigation that investigates the actions of “digital militias” – in the decision, Moraes wrote that the former parliamentarian “is part of the political nucleus” of a criminal organization “which has as one of its purposes to destabilize republican institutions”.
“The Federal Public Ministry, through the Attorney General of the Republic to which it subscribes, in the use of its legal attributions, comes, in the form of article 129, item I, Federal Constitution, and article 6, item V, Complementary Law No. 75 /93, comes, before Your Excellency, to expose and request the following. The Federal Public Ministry offers a complaint against Roberto Jefferson Monteiro Francisco for infringement of arts. 23, IV, c/c 18, both of Law 7.170/1983 (three times, pursuant to article 71 of the Penal Code, 286 c/c 163, sole paragraph, II and III, both of the Penal Code, 26 of the Law 7170/1983 and 20, § 2, of Law 7716/1989 (twice, pursuant to article 71 of the Penal Code). Considering that the accused is not included in the list of article 102, I, “b ” of the Federal Constitution, the Public Prosecutor’s Office requires that any decline in jurisdiction be considered. At this moment, it also asks for the consideration of the application for house arrest”, says the eight-page document. Lindôra also lists a series of interviews and statements in which Roberto Jefferson encourages the population to invade the National Congress, react to police officers and attack institutions, including the Supreme Court.
This Monday, 30, after the complaint filed by the PGR, minister Alexandre de Moraes decided to lift the confidentiality of the records of the investigation against Jefferson. “In the case of the records, although the need to comply with the determined steps required, in principle, the imposition of confidentiality to the all the records, it is certain that, given its implementation, there is no need to maintain full advertising restriction. In addition, the decision that granted the steps required by the totorityand a police officer was made public on 8/13/2021, due to numerous journalistic publications of incomplete excerpts of its content. Thus, it is certain that the object of the investigation conducted in these case file is public knowledge, a circumstance that, in this specific case,reinforces the need to lift secrecy,” says Moraes’ decision. Wanted by Young pan, the lawyer Luiz Gustavo Cunha, who represents Jefferson, stated that he has not yet had access to the decision and that he will manifest himself after having access to the records.
