Parliamentarian is accused of being responsible for the murder of her husband, Pastor Anderson do Carmo; expulsion decision will still be submitted to the Chamber of Deputies
The 2nd Criminal Chamber of the Rio de Janeiro Court of Justice on Tuesday, 23, unanimously removed the federal deputy Flordelis (PSD-RJ) of his position. The parliamentarian is accused of being the principal of the murder husband, the pastor Anderson do Carmo, who was murdered on June 16, 2019, with more than thirty shots. A granddaughter and six of Flordelis’ 55 children are in jail awaiting trial. As in the case of the deputy Daniel Silveira, who was arrested after publishing a video with attacks on the Supreme Federal Court, the decision of the TJ-RJ will be submitted to the plenary of the Chamber of Deputies, which should decide whether or not to maintain the removal of the parliamentarian.
Judges Antonio José Ferreira de Carvalho and Kátia Maria Amaral Jangutta followed the vote of the rapporteur, Judge Celso Ferreira Filho, who determined that the decision be sent to the Chamber within 24 hours. “I am voting, therefore, to hear the appeal in order to grant it to determine the suspension of the exercise of any public function of the defendant, including the parliamentary one until the complete exhaustion of the final judgment, for a maximum period of one year, sending this decision is made, within 24 hours, to the Chamber of Deputies, to decide in the manner provided for in article 53, paragraph 2, of the Federal Constitution ”, declared the rapporteur.
“Initially, it should be pointed out that it is irrefutable that the condition of federal parliamentarian who currently has the defendant now provides him with an advantageous situation in relation to the other defendants in the original criminal action. So much so, that she was not taken to prison. Unquestionable, too, that the political, administrative and economic power of the defendant now assures him of the use of the most diverse means, in order to make his defensive thesis prevail ”, justified Ferreira Filho about his decision. According to him, there is evidence on social networks of dialogues in which Flordelis intimidates and persuades witnesses and prisoners. For the judge, this means interfering with the verification of the truth of the facts. “Likewise, there is no doubt that, due to the role she performs, she has means and ways of accessing information and systems, in the face of the relationships she maintains due to the parliamentary role. The other 10 defendants, including natural and adopted children, are awaiting the decision of the 3rd Criminal Court of Niterói to find out if they will go to a popular jury.
