O Supreme Federal Court (STF) resumes on Thursday, 15, the judgment on the annulment of the former president’s convictions Luiz Inácio Lula da Silva. By 9 to 2, the ministers rejected the petista’s defense request for the analysis to stay with the Second Panel. Rapporteur of the Car wash at the Court, Edson Fachin argued that the issue should continue in the plenary session. “In my understanding, there is regularity, so it is regular to accept the plenary of this Supreme Federal Court,” he said. Ricardo Lewandowski disagreed. “The aforementioned provisions of the STF’s internal regulations do not authorize the discharge of appeals filed against the monocratic decision of the rapporteur to the plenary,” he said. He and Marco Aurélio, however, ended up defeated by the majority. This Thursday’s session is scheduled to happen at 2pm.

Ministers must decide whether the annulment of the proceedings undermines the debate over Sergio Moro’s bias or whether the Second Panel could have taken the decision. If Edson Fachin’s understanding is maintained, Lula will have his political rights resumed and will be able to run in the 2022 elections. Minister Carmen Lúcia also anticipated this Wednesday that it would not be up to the plenary to rediscuss the former judge’s suspicion, since the matter was decided by the Second Panel of the STF. This Thursday, the plenary should start discussing the appeals of the Attorney General’s Office against the annulment of the former president’s convictions.
