Recent developments in the de facto republic of South Ossetia are the subject of public debate. Civil activists believe that e. წ. Some members of parliament, who should set an example for others to follow the law, have become law-breakers and executors of Bibilov’s directives.
E. of the occupied Tskhinvali region. წ. The parliamentary opposition in those 18 e. წ. Complains MP who held a de facto parliamentary session on February 16, despite the lack of a quorum. The subject of the lawsuit is violation of the regulations. They also intend to apply to the Prosecutor General’s Office as the oversight body, and to the de facto president as e.g. წ. The guarantor of the protection of the Constitution, the seizure of power by these MPs, which is a serious crime.
On February 16, 18 of the 34 members of the de facto South Ossetian parliament e. წ. The MP, despite the lack of a quorum, held a session of the legislature and approved the 2021 budget.
It is obvious that 18 e. წ. The MP obeyed the instruction of de facto President Anatoly Bibilov to adopt the budget by any means, regardless of whether the striking MPs attended the sitting or not.
“Do not wait for those who do not think about people. Do what you have to do for your people. No one will tell you anything, even if you do not do it in accordance with the regulations. You will do it for your people. We do not touch the law. Regulations are not the law. “Even if we go against the rules a little bit, but do it for the sake of thousands of people, these people will thank you.”, – Bibilov called on the deputies supporting him on Friday.
The oppositionist E. წ. Zita Besaeva, an MP from the Nikhas party, told Echo Kavkaza that some of the MPs consider the adoption of the budget illegal.
In our opinion, the foundations of the constitutional system of the Republic of South Ossetia have been violated, Article 1, paragraph 4 of which states: “No one can usurp power in the Republic of South Ossetia. “Seizure of power or usurpation of power is the gravest crime against the people and is punishable by law.” Eighteen members of parliament did just that – they seized power and thus committed grave crimes against the constitutional order. They have to answer for that. “
Opposition “MPs” are going to file a complaint with the Prosecutor General’s Office for violating the law. In addition, a lawsuit is filed against e. წ. The Supreme Court, due to procedural irregularities, demanded the annulment of all decisions made at the de facto Parliament session on 16 February. The “deputies” are also going to apply to the “president” as a guarantor of the protection of the Constitution, so that he does not sign the budget, which was adopted in violation of the basic law.
“Given that power today is in the hands of one team and no branch of power is independent, I do not have much hope for the right decision. In any case, we have the right to appeal to the court and it is obliged to consider our claim. “ – says Zita Besaeva.
According to Tskhinvali civil activists, the efforts of the striking MPs to return the “Republic” to the legal framework, the result was not the same. წ. Will follow in court. According to a source close to Radio Liberty, a representative of the civil sector, signs of a deepening crisis are already evident.
“Nobody here hopes that we will return to the legal framework. These deputies obeyed the order of the President and knew full well that they were acting illegally. With that, both the president and they told us all, the law is here for us and we can do whatever we want. All this will not end without a trace. The bowl of patience will soon be filled and people will not tolerate injustice as Inal Jabiev’s family cannot tolerate it. “The cascade of injustice has started with the murder of Inali and it all continues with lawlessness and injustice.
The political crisis in the occupied region of Tskhinvali began in August last year. Inal Jabiev, 30, died on August 28, 2020, before being taken to a hospital in Tskhinvali. Jabiev was suspected in the August 17 armed attack on the car of de facto Interior Minister Igor Naniyev. Reports that Inal Jabiyev’s death was allegedly caused by his beating and torture in solitary confinement were followed by protests. The de facto government resigned amid mass unrest, with several local militia members being held accountable, although de facto Prosecutor General Uruzmag Jagaev retained his position. His resignation e. წ. A majority of MPs are still in demand.
Two months ago, a protest rally organized by Inal Jabiev’s family in the center of Tskhinvali began demanding a fair investigation and the punishment of the accomplices in the murder.
