Morocco and sexual harassment

The results of an official study in Morocco showed sexual harassment the types of violence that women are subjected to in public places.

According to a note on “violence against women and girls” published by the High Commission for Planning, and based on the results of the national research on violence against women and men in 2019, out of 12.6% of women who experienced violence in public places during the past 12 months, 7.7 % were victims of sexual violence.

The Moroccan law on combating violence against women, which entered into force in September 2018, includes provisions penalizing sexual harassment in public spaces, whether by “acts, words, or signs of a sexual nature or for sexual purposes,” including imprisonment from one month to one. However, human rights advocates warn that in many cases, victims of sexual harassment are unable to report what they are exposed to, due to the obstacles they face, mainly represented in the difficulty of proof and the view of society.

Although she praised a number of provisions of the law related to combating violence against women, such as “increasing the penalty for some acts and criminalizing others that were not previously criminalized,” the lawyer and human rights lawyer, Fatiha Shtato confirms that two years of its implementation showed that it involves a set of “ loopholes.”

According to what Chtatou explains in a statement to “Aswat Magharebia”, “this law does not provide prevention” and “does not intervene until after the damage has occurred.” sexually, because they are obliged to prove what they have been exposed to.

The spokeswoman stresses the “difficulty of proof” in these cases, stressing that this prevents many victims from reporting, especially since they also suffer from “the view of society that holds victims of harassment and rape responsible for what they have been exposed to.”
