The Justice maintained a 5 pm schedule for the mandatory closing of bars and restaurants, according to the decree of the Rio de Janeiro. The decision, this Saturday (6), preliminary injunction granted last Friday (5) to Brazilian Association of Bars and Restaurants (Abrasel), which allowed opening until 8pm. The measure was granted by the president of the Court of Justice (TJ), Judge Henrique Carlos de Andrade Figueira, after a request made by the Attorney General of the Municipality. In the decision, Figueira stressed that it is up to the Executive Branch to take the necessary measures to prevent Covid-19.
“It is up to the Executive Branch, exclusively, to adopt the measures it deems reasonable and necessary for the circulation of people and the functioning of commercial establishments. In the hypothesis in question, the municipality determined strict measures that effectively interfere with commercial activity and freedom of movement, considering the prohibition of stores operating, either during normal or reduced hours, in addition to prohibiting people from moving in the city in question. time defined in the norm ”, wrote the judge.
According to him, the closing of bars and restaurants does not mean the interruption of the provision of services, which can be done through the tele-delivery system. “Being in a bar or restaurant allows the regular to go without a mask to eat, which is not conceived in other branches of activities. In addition, closing the bars and restaurants as defined in the decree does not mean the suppression of business activity, as it is curial to work with the home delivery system, without any restriction in the norm ”. In its injunction request, Abrasel argued that different treatment was provided to other sectors of economic activities with public service, such as shopping centers, gyms and beauty salons, authorized to operate from 6 am to 8 pm.
