The President of the Legislative Assembly of São Paulo (Alesp), Carlão Pignatari (PSDB), denied the possibility of modifying the penalty imposed on the Ethics Council on the state deputy Fernando Cury (Citizenship), which, in December 2020, was caught by Alesp’s cameras touching his colleague Isa Penna (PSOL). He was punished by the board with 119 days of unpaid suspension. Isa and his allies filed an amendment modifying Cury’s sentence from suspension to forfeiture. In a statement published in the Official Gazette of the State, Pignatati stated that “the Plenary, duly provoked, must exercise, sovereignly, the prerogative of approving or not approving the proposal to impose the penalty, without, however, having the prerogative to modify it” . “And, for that reason, the draft resolution through which it proposes the application of the sanction is not subject to amendment,” he added.
Congresswoman Isa Penna used her Twitter to inform that she will take the matter to court. “I just filed with the deputy Emídio de Souza (PT), , who was the rapporteur of the case in the Ethics Council, a writ of mandamus asking the plenary to vote the impeachment of Fernando Cury ”, he wrote. “It is unacceptable that the harasser continues to legislate normally with a mild punishment that does not take away his political rights, only removes him for 119 days with guaranteed salary for his entire office. That is if they vote in favor of this punishment ”, he justified. The vote on the suspension of Fernando Cury will be held on Wednesday, 31.
